Bing was designated a VLOSE on 25 April 2023 on a declared 119 million average monthly active recipients in the Union.
Bing’s designation is notable for having absorbed a generative layer: Copilot answers sit inside the designated search surface, which is part of why the Commission’s later reasoning on ChatGPT — that a conversational interface which queries the open web is a search engine for DSA purposes — had a precedent to build on.
No formal proceeding has been opened against Bing to date.
